Terms & Conditions

1. Introduction

By accessing or using the services of Body Maintenance Centre (“we,” “us,” or “our”), including any facilities or digital platforms, and completing any associated Informed Consent forms, you (“Client” or “you”) agree to be bound by these Terms and Conditions, including the Client Disclaimer outlined below. If you do not agree, you must not use our services.

2. Personal Belongings

Body Maintenance Centre is not responsible for any lost, stolen, or damaged valuables, cash, or personal items while on our premises or at any partnered Facility.

3. Compliance

You agree to comply with all rules, instructions, and safety directives issued by Body Maintenance Centre and any Facility where our services are provided.

4. Voluntary Participation

Participation in our services is voluntary. You acknowledge that you are engaging in services at your own free will and assume all risks associated with such participation.

5. Medical Information & Confidentiality

You confirm that all medical history, current health status, and relevant conditions have been accurately and fully disclosed.

Body Maintenance Centre may store this information securely within its practice management software (Halaxy) and exercise-prescription software (Trainerize and Physitrack) for purposes of assessment, treatment planning, exercise programming, and ongoing care. These systems are password-protected and operate in accordance with their published privacy policies. By using our services, you consent to the collection, storage, and use of your personal and medical information in these platforms for service delivery.

6. Media Consent

You grant Body Maintenance Centre and its affiliates permission to use photographs and video footage of you for marketing purposes, including print, web, and online advertising. Clients may notify us in writing if they wish to opt out.

7. Scope of Consent

This consent applies to all services provided by Body Maintenance Centre, including hydrotherapy and manual therapy, and extends to any Facility used in connection with these services.

8. Payment Authorisation & Confidentiality

If you provide credit card or payment details, you authorise Body Maintenance Centre to store and process these through its practice management software (Halaxy) and exercise-prescription software (Trainerize and Physitrack) for the purposes of payment and secure storage of related health and exercise information.

You acknowledge that Body Maintenance Centre is not responsible for storage or processing beyond securely entering information into these systems and accept the confidentiality, privacy, and payment processing terms of the relevant platforms.

9. Acknowledgement of Risk

You understand that participation in our services and use of the Facility involves inherent risks, including physical or non-physical harm. You accept these risks, which may include injury, property damage, or death.

10. Exercise Risks

Exercise and physical activity are physically demanding. You acknowledge and accept the risks associated with your participation.

11. Release and Indemnity

To the fullest extent permitted by law, you release and indemnify Body Maintenance Centre, its employees, contractors, directors, affiliates, and any Facility from any claims, damages, or liabilities arising from your use of the services or Facility, whether arising from negligence, accident, or other causes.

12. Duty of Care & Treatment Risks

Professional treatments (e.g., massage, myofascial release, traction, joint mobilisation) are generally safe; however, a small risk of injury exists, including but not limited to injury to nerves, bones, muscles, ligaments, discs, or arteries. Other possible risks include allergic reactions to topical products or minor bruising.

Clients will be informed of examination results and proposed treatments before consent is sought and have the right to refuse treatment or seek a second opinion. Relevant information may be shared with medical practitioners or trainers unless confidentiality has been expressly requested.

13. Infectious Diseases

Clients must inform therapists of any infectious diseases (e.g., TB, HIV, Hepatitis, Glandular Fever, Golden Staph), as certain manual therapies may increase transmission risk.

14. Medicare & Appointment Policies

For Medicare Chronic Disease Management Plan sessions, if a claim is denied, clients agree to pay any outstanding balance directly. A minimum of 24 hours’ notice is required for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee.

15. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising from your use of services or these Terms will be subject to the jurisdiction of the courts of Victoria, Australia.
